Documents Needed to Sell a Car Privately in California

Selling a car in California usually requires far less paperwork than people expect. If the California title is in your name and the vehicle has no unusual ownership issues, the title is the central document needed to begin.

The Short Answer

For a straightforward California vehicle sale, start with:

Your California Certificate of Title, commonly called the pink slip

Depending on the vehicle, you may also need:

California Certificate of Title

The California Certificate of Title is the primary ownership document. The registered owner signs the title to release their interest in the vehicle, and the buyer uses the endorsed title to apply for the ownership transfer.

Before signing, verify that the name on the title is correct and that every required owner can participate in the sale. Do not make alterations or use correction fluid on the title.

If the title has been lost, stolen, or damaged, a California Application for Replacement or Transfer of Title may be required. A missing title does not necessarily prevent the sale, but it should be addressed before completion.

Notice of Transfer and Release of Liability

California sellers must notify the DMV of the sale by submitting a Notice of Transfer and Release of Liability within five calendar days.

This notice can be filed online and records the buyer's information, vehicle information, sale date, mileage, and sale price. It is an important seller-protection step, but it does not transfer ownership by itself.

Odometer Disclosure

An odometer disclosure is required for many vehicle transfers, generally when the vehicle is less than 20 model years old.

In a standard transaction, the mileage may be recorded directly on the title. A separate Vehicle/Vessel Transfer and Reassignment Form may be required in certain situations, such as when the title does not contain the necessary odometer section.

You do not need to obtain a separate form unless the transaction requires one.

Smog Certification

California generally requires the seller of a gasoline or hybrid vehicle to provide a valid smog certification unless an exemption applies.

Battery-electric vehicles do not require a California smog inspection. Newer vehicles, certain family transfers, and other qualifying transactions may also be treated differently.

Financed Vehicles and Lender Payoffs

You may sell a vehicle that still has an outstanding loan. The lender must provide the current payoff amount, and the lien and title requirements must be completed as part of the transaction.

You do not necessarily need to pay off the loan before requesting or accepting an offer. Provide the lender's name and available account or payoff information, and the applicable completion process can be coordinated from there.

Is a Bill of Sale Required?

A separate California Bill of Sale is not required in every standard transaction when the properly endorsed title contains the necessary information.

It may still be useful for the parties' records or required when the ownership history, title, or transfer circumstances call for additional documentation.
